Copyright & DMCA Notice
This notice explains how the Khmer Beat website and progressive web app at khmerbeat.com (the "Service"), operated by the Khmer Beat team ("Khmer Beat", "we", "us"), handles copyright and how rights holders can ask us to remove or correct a work. It should be read together with our Terms of Service and Privacy Policy.
1. Overview
Khmer Beat respects the intellectual‑property rights of artists, composers, producers, labels and other rights holders, and expects the people who use the Service to do the same. The catalogue is a curated, promotional selection of Khmer music. We make no claim of ownership over the sound recordings, musical compositions, lyrics or artwork in it, and we do not represent that the Service is licensed, official or endorsed by any rights holder. If you hold rights in a work that appears on the Service and you want it removed or corrected, tell us using the process below and we will act promptly.
2. How we handle the catalogue
- We do not knowingly include a work against the wishes of its rights holder.
- On a valid request from a rights holder, or someone authorised to act for one, we remove or disable access to the work expeditiously.
- We keep a record of the requests we receive and the action we take on each one.
- Where an authorised recording is already published by the rights holder on a platform such as YouTube, we prefer to feature that official version rather than host our own copy.
3. Submitting a takedown request
Send a written notice to our copyright contact at the address in section 8. To let us act on it quickly, please include all of the following:
- your name, and the rights you hold — or, if you are acting for someone else, who you act for and your authority to do so;
- identification of the copyrighted work you say is infringed (for example the artist name, song title and album);
- the exact khmerbeat.com URL(s) of the material you want removed or disabled;
- contact details we can use to reach you — an email address, and a postal address and telephone number if possible;
- a statement that you have a good‑faith belief that the use of the material in the way complained of is not authorised by the rights holder, its agent, or the law;
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the rights holder or are authorised to act on the rights holder's behalf;
- your physical or electronic signature.
When we receive a complete notice we disable access to the identified material expeditiously. We may contact you if we need clarification, and we may forward your notice (including your contact details) to the person who supplied the material.
4. Counter‑notification
If a work of yours was removed and you believe this happened through mistake or misidentification, or that you are in fact authorised to use it, you may send a counter‑notification to the same address. It must include:
- your physical or electronic signature;
- identification of the material that was removed and the location (URL) where it appeared before removal;
- a statement under penalty of perjury that you have a good‑faith belief the material was removed or disabled as a result of mistake or misidentification;
- your name, postal address and telephone number, and a statement that you consent to the jurisdiction of the courts of the Kingdom of Cambodia (or, if you are in the United States, of the Federal District Court for the district in which your address is located), and that you will accept service of process from the person who gave the original notice or their agent.
If we receive a valid counter‑notification we may restore the material unless the original complainant informs us that they have started legal action to keep it down within a reasonable time.
5. Repeat infringers
We will, at our discretion, stop including content from a source that is the subject of repeated valid infringement claims, and we may suspend or close the account of any user who repeatedly adds infringing material through the Service — for example playlist titles, descriptions or cover images they do not have the right to use.
6. Artists and rights holders
If you are an artist, producer or label, we would like to hear from you — whether you want your music featured, promoted differently, licensed, credited another way, or removed. Email dmca@khmerbeat.com or support@khmerbeat.com and we will respond.
7. Trademarks and other intellectual property
The "Khmer Beat" name, logo, and the design and software of the Service are owned by Khmer Beat or its licensors. If you believe the Service infringes a trademark or another intellectual‑property right, report it to the address below with the same level of detail as a copyright notice.
8. Copyright contact
Copyright and DMCA matters: dmca@khmerbeat.com. This address is only for copyright notices and counter‑notifications. For anything else, use support@khmerbeat.com.
9. Not legal advice; changes
This notice describes the process we follow; it is not legal advice, and submitting or receiving a notice under it does not create any legal relationship beyond that process. We may update this notice from time to time; when we do we will change the "Last updated" date above.
