Terms of Service
These Terms of Service ("Terms") govern your use of the Khmer Beat website and progressive web app at khmerbeat.com, and the Khmer Beat Android app — published on Google Play as Khmer Song Lite - Music Player — (together, the "Service"), operated by the Khmer Beat team ("Khmer Beat", "we", "us"). "Khmer Beat" and "Khmer Song Lite - Music Player" refer to the same product; these Terms use "Khmer Beat" throughout. By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Khmer Beat is a music‑streaming application focused on Khmer songs. It lets you browse and stream a catalogue of songs, albums and artists, and — if you create an account — build playlists, save liked songs, follow artists and keep a listening history. The Service is provided free of charge and is under active development; features may be added, changed or removed.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, you may only use the Service with the involvement and consent of a parent or legal guardian, who is responsible for your use.
3. Your account
- Provide accurate information when you register and keep it up to date.
- Keep your password and sign‑in method secure; you are responsible for activity under your account.
- One account per person. Do not share your account or use someone else's.
- Tell us promptly at the address in section 15 if you believe your account has been compromised.
- We may suspend or close an account that breaches these Terms or is used unlawfully.
4. Acceptable use
When using the Service you agree not to:
- use it for any unlawful purpose or in breach of any applicable law or third‑party right;
- copy, download, record, re‑stream, redistribute, sell or publicly perform the audio or other content, except for the personal streaming expressly allowed by section 5;
- use bots, scrapers or other automated means to access the Service or bulk‑collect data from it;
- circumvent, disable or interfere with access controls, rate limits or security features, or probe or scan the Service or its infrastructure;
- reverse engineer, decompile or disassemble the Service except to the limited extent the law permits despite this restriction;
- upload or create playlist names, descriptions, cover images or profile details that are unlawful, infringing, hateful, harassing, deceptive or that you do not have the right to use;
- impersonate any person or misrepresent your affiliation with anyone;
- disrupt the Service or degrade the experience of other users, or place unreasonable load on our systems.
5. Music and other catalogue content
Songs, recordings, artwork and related metadata in the Service belong to the artists, labels and other rights holders, and are made available to us or our providers under licence. Subject to these Terms, we grant you a personal, limited, non‑exclusive, non‑transferable and revocable licence to stream that content for your own private, non‑commercial listening. You get no ownership of it, and no right to download or retain copies. Availability of any particular track, album or artist may change or be withdrawn at any time. 6. Content you create
"Your Content" means the material you add through the Service — playlist titles and descriptions, playlist cover images you upload, and your likes and follows. You keep whatever rights you already hold in Your Content. You grant Khmer Beat a worldwide, non‑exclusive, royalty‑free licence to host, store, reproduce, adapt for display, and communicate Your Content solely to operate and provide the Service — including showing a public playlist and its details to other users if you choose to make it public.
You are responsible for Your Content and confirm you have the rights needed to add it and to grant the licence above. We may remove content that we reasonably believe breaches these Terms or the law.
7. Our intellectual property
The Service itself — its software, design, layout, graphics, the "Khmer Beat" name and the logo — is owned by Khmer Beat or its licensors and is protected by intellectual‑property laws. We grant you a limited, revocable licence to use the Service as intended by these Terms. All rights not expressly granted are reserved.
8. Third‑party services
The Service runs on and integrates third‑party providers, including Supabase (database, authentication and file storage), Cloudflare (hosting, content delivery and DNS) and, if you choose it, Google or Facebook Sign‑In. The Android app additionally uses Google Firebase (analytics, crash reporting and push notifications) and shows ads through Google AdMob and the Meta Audience Network — see the Privacy Policy for details. Your use of those features is also subject to the relevant provider's terms and privacy policy. We are not responsible for third‑party services and do not control them.
9. Availability and changes
We aim to keep the Service available but do not guarantee it will be uninterrupted, error‑free or secure. We may modify, suspend or discontinue any part of the Service, and may set or change limits on features, at any time. Where reasonable we will give notice of significant changes.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non‑infringement, to the fullest extent permitted by law. We do not warrant that any content is accurate, complete or continuously available.
11. Limitation of liability
To the fullest extent permitted by law, Khmer Beat and the people who work on it will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, goodwill or opportunity, arising out of or relating to your use of (or inability to use) the Service. Because the Service is free, our total liability to you for all claims relating to the Service will not exceed USD 50 or the amount you paid us in the 12 months before the claim, whichever is greater. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Indemnity
You agree to indemnify and hold Khmer Beat harmless from claims, damages and expenses (including reasonable legal fees) arising from your misuse of the Service, your breach of these Terms, or Your Content.
13. Suspension and termination
You may stop using the Service at any time and may delete your account (see the Privacy Policy for how to request deletion). We may suspend or terminate your access if you breach these Terms, if required by law, or if continuing to provide the Service to you would create risk or liability for us. On termination, the licences granted to you end; sections that by their nature should survive (for example 5–7 and 10–15) continue to apply.
14. Governing law
These Terms are governed by the laws of the Kingdom of Cambodia, without regard to conflict of law rules. The courts located in Phnom Penh, Cambodia have exclusive jurisdiction over any dispute, subject to any mandatory consumer‑protection rights you have where you live.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date above and, for material changes, provide reasonable notice through the Service. Your continued use after the changes take effect means you accept the updated Terms.
